Terms of Service

These Terms of Service (“Terms”) govern your engagement with 2RS Security Limited (“we”, “us”, “our”), a Nairobi-based private security company providing comprehensive, high-quality security solutions across East Africa, Central Africa, and expanding throughout the continent. By engaging our services, accessing our website, or entering into any agreement with us, you (“Client”, “you”) agree to these Terms.

1. Definitions

  • “Services” — manned guarding, CCTV/surveillance installation & monitoring, alarm response, risk & vulnerability assessments, event security, executive protection, access control, cybersecurity consulting, training, and related solutions.
  • “Contract” — any service agreement, proposal, quotation, or purchase order accepted by both parties.

2. Scope of Services

We provide professional, licensed, and insured security services tailored to your needs. Services are delivered with due care, skill, and in compliance with Kenyan laws, industry standards, and any applicable regional regulations in our areas of operation.

3. Client Obligations

You agree to:

  • Provide accurate, complete information and access necessary for service delivery.
  • Comply with all security protocols, site rules, and instructions from our personnel.
  • Maintain safe premises and notify us promptly of hazards or changes.
  • Not interfere with or misuse our equipment/personnel.

4. Fees, Payment & Billing

Fees are as stated in the Contract. Invoices are due within agreed terms (typically 30 days). Late payments attract interest at 2% per month. We reserve the right to suspend services for non-payment after notice.

5. Liability & Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for losses due to force majeure, your negligence, third-party acts, or events beyond reasonable control.
  • Our total aggregate liability (contract, tort, or otherwise) shall not exceed the fees paid by you in the 12 months preceding the claim.
  • We exclude liability for indirect, consequential, punitive, or special damages (lost profits, business interruption, data loss, etc.), even if advised of possibility.
  • Nothing limits liability for death/personal injury caused by our gross negligence or willful misconduct.

6. Insurance

We maintain appropriate general liability, professional indemnity, and workers’ compensation insurance. Certificates available upon request.

7. Termination

Either party may terminate for material breach (with 30-day cure period) or as specified in the Contract. Upon termination, you remain liable for accrued fees.

8. Confidentiality & Data Protection

Both parties protect confidential information. Personal data is processed per our Privacy Policy and the Data Protection Act, 2019.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of Kenya. Disputes shall first attempt amicable resolution; failing that, exclusive jurisdiction of Kenyan courts.

10. Miscellaneous

These Terms, together with the Contract, constitute the entire agreement. Amendments must be in writing. If any provision is invalid, the remainder remains enforceable.
